1. Introduction

The Digital Millennium Copyright Act (DMCA) is a United States copyright law that was enacted on October 28, 1998. The DMCA implements two 1996 treaties of the World Intellectual Property Organization (WIPO) and is designed to update copyright laws for the digital age. This legislation provides a framework for copyright holders to protect their works online and establishes a safe harbor for online service providers (OSPs) from liability for copyright infringement, provided they comply with certain requirements. The purpose of this document is to outline the policies and procedures that govern the handling of copyright infringement claims on The Service, ensuring compliance with the DMCA and protecting the rights of copyright owners.

2. Safe Harbor Provisions

Under the DMCA, online service providers may qualify for safe harbor protection, which shields them from liability for infringing content uploaded by users, provided they meet specific criteria. To qualify for safe harbor, The Service must not have actual knowledge of infringing activity, must not be aware of facts or circumstances that would make infringing activity apparent, and must act expeditiously to remove or disable access to infringing material upon receiving proper notification from the copyright owner. This means that The Service must implement a policy for addressing claims of copyright infringement and must take appropriate action when notified.

3. Notification of Infringement

To initiate a copyright infringement claim, a copyright owner or their authorized agent must submit a written notification to The Service's designated agent. This notification must include the following information: a physical or electronic signature of the copyright owner or a person authorized to act on their behalf; identification of the copyrighted work claimed to have been infringed; identification of the material that is claimed to be infringing and information reasonably sufficient to permit The Service to locate the material; the contact information of the complaining party, including an address, telephone number, and email address; a statement that the complaining party has a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and a statement that the information in the notification is accurate, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

4. Counter-Notification

If The Service removes or disables access to material in response to a notification of infringement, the affected user may submit a counter-notification. A counter-notification must include the following information: a physical or electronic signature of the user; identification of the material that has been removed or to which access has been disabled; a statement under penalty of perjury that the user has a good faith belief that the material was removed or disabled as a result of a mistake or misidentification; the user's name, address, telephone number, and a statement that the user consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if the user's address is outside of the United States, for any judicial district in which The Service may be found; and a statement that the user will accept service of process from the person who provided the original notification of infringement or an agent of such person.

5. Repeat Infringers Policy

The Service maintains a policy for the termination of accounts of users who are found to be repeat infringers. A repeat infringer is defined as a user who has been the subject of multiple notifications of infringement. Upon receiving a notification of infringement, The Service will investigate the claim and, if warranted, will take appropriate action, which may include removing the infringing material or terminating the user's account. This policy is designed to deter copyright infringement and to protect the rights of copyright owners.

6. Limitations of Liability

The DMCA provides certain limitations on liability for online service providers. Specifically, The Service is not liable for any damages resulting from the removal or disabling of access to material that is claimed to be infringing, provided that such actions are taken in good faith and in accordance with the DMCA. Furthermore, The Service is not liable for any damages resulting from the failure to remove or disable access to material that is claimed to be infringing, unless it can be shown that The Service had actual knowledge of the infringing activity or was aware of facts or circumstances that made the infringing activity apparent.
